I do not accept all cases, but I am available to be the primary guardian for a full guardianship or limited guardianship. I consider each case separately based on a review of the facts and circumstances. I will need to review paperwork and speak to the client and others who care about their well being.
Sometimes a family member or other person, including another professional guardian, would like either regular on-going assistance or just occassional assistance with a client. I can be appointed as Co-Guardian to work simultaneously with the other guardian with a clear plan of my involvement and limitations.
Every person who is a Guardian must nominate a Standby Guardian, a person to step up and act as guardian should something happen to the primary guardian. If the circumstances are right, I can be persuaded to be your Standby Guardian.
As an attorney I can help you establish a guardianship and teach you the best practices of performing your legal duties as a guardian. Because I am also an active guardian myself, I can add some practical advice and warnings that perhaps other attorney's may not be as familiar since they don't act as a guardian on a daily basis. This added perspective makes me give more education rather than less.
As an attorney I can assist you in preparing for your court appearances required by law every 1 to 3 years. It is very important to know that you prepare for those reports to the court from the BEGINNING of the guardianship and every month. If you don't keep up on the records and other tasks, it can be overwhelming when the time comes to collect all the information required by the courts.
If a Special Nees Trust is needed, I can assist with both the creation and the administration of that trust. Very specific laws and rules must be followed to make sure the client maintains eligibility for state and federal benefits. Many times my fees as attorney or guardian can come from the benefits already available to the client as well as getting the state to reimburse for those fees in the form of a reduction in "participation" toward their daily care, if applicable. In any case I make sure it is possible to maintain the client's monthly needs prior to me getting paid.
These are pictures from one of many different outings. This outing was to a go cart speedway where we drove fast go carts; played pool and games; and went for dinner and desert. (Some of us crashed so much I thought I'd have a heart attack, but we all were safe and had fun!
